 As a young company, we are continually working to make our cases better! From the first round of production, we have made many improvements. We have upgraded the case material to a vegan leather. We have also increased the bumper height. Most recently, we improved the quality of the finger loop/kickstand strap. If there is an area of our case you think can be improved, please let us know by emailing us at [email protected]. We look forward to what the future holds for Walli!

Consumer Product Labelling Checklist:

 Determine if the product is subject to a safety rule that requires prior certification from the Consumer Product Safety Commission (“CPSC”).

Confirm whether the product is designed or intended primarily for use by children. If so, ensure that it includes a tracking label, that is, a label that includes the following information:

  • manufacturer or private labeler name;
  • date and place of production of the product (a product may not be labeled as being “Made in USA” unless it is “all or virtually all” made in the USA);
  • batch or run number, or other similar identifying information; and
  • any other information to help identify the specific source of the product.

Consider whether the product may be classified as a hazardous substance under the Federal Hazardous Substances Act (“FHSA”) (such as cigarette lighters, cleaning products, art materials, and balloons), which identifies hazardous substances as those that:

  • are toxic, that is, poisonous;
  • are corrosive, like strong acids;
  • are irritants, that is, substances that cause minor pain or discomfort;
  • are strong sensitizers, that is, cause development of an allergic reaction in normal tissue after repeated exposure;
  • are flammable or combustible, that is, easily set on fire;
  • generate pressure from decomposition, heat, or other means where this may cause substantial personal injury or illness during or as a result of reasonably foreseeable handling or use, including ingestion by children;
  • are radioactive, if determined by the CPSC to be hazardous; or
  • are toys or other articles intended for use by children that the CPSC determines to present an electrical, mechanical, or thermal hazard.

If a hazardous substance, confirm that the labeling includes:

  • the name and business address of the manufacturer, packer, distributor or seller;
  • the common or usual or chemical name of each hazardous ingredient;
  • the signal word “Danger” for products that are corrosive, extremely flammable, or highly toxic;
  • the signal word “Caution” or “Warning” for all other hazardous products;
  • a statement describing the principal hazard or hazards that the product presents, for example, “Flammable” or “Harmful if Swallowed”;
  • instructions to users on what users can do or what actions to avoid to best protect themselves while using the product;
  • where pertinent, instructions for first aid treatment to perform if the product injures someone;
  • the word “Poison” for highly toxic products;
  • where required, special care instructions; and
  • the statement “Keep out of the reach of children.”

If the product is clothing or a textile, be sure that the labeling complies with the requirements of the Textile Products Identification Act by confirming that the label includes:

  • fiber content;
  • country of origin;
  • either the company name or Registered Identification Number of the product’s manufacturer, importer, marketer, or distributor; and
  • care instructions or warnings if the garment cannot be cleaned without harm or requires special handling.

If the product includes fur, confirm compliance with the Fur Products Labeling Act by ensuring that the label includes:

  • the name of the animal from which the fur was obtained;
  • whether the fur is pointed (that is, had hairs inserted either to repair damaged areas or to simulate other furs), dyed, bleached, or artificially colored;
  • whether the fur is composed of pieces; and
  • whether it is used or damaged.

Proposition 65 Warning:

The Proposition 65 product warning requirement applies to Walli if:

When the Proposition 65 warning requirement applies to a company and its product, the warning must be:

Given before the sale of the product, on:

  • the product itself;
  • the shelf or signage at each point of the product’s display; or
  • a website that sells and ships to California residents.

Specific Requirements: Warning Language. Unless a Proposition 65 product warning is a short-form warning on a product label, the language must specify at least one chemical that has prompted the warning. When a warning is given for both cancer and reproductive harm because of different chemicals in a product, the warning must specify at least one chemical in each category.

For exposures to carcinogens on the Proposition 65 list, warning language should read:

This product can expose you to chemicals including [name of one or more chemicals], which is [are] known to the State of California to cause cancer. For more information go to www.P65Warnings.ca.gov.”

For exposures to chemicals that are on the Proposition 65 list for reproductive harm, warning language should read:

"This product can expose you to chemicals including [name of one or more chemicals], which is [are] known to the State of California to cause birth defects or other reproductive harm. For more information go to www.P65Warnings.ca.gov.“

When a warning is for both carcinogen exposure and reproductive harm exposure from different chemicals, the warning language should read:

"This product can expose you to chemicals including [name of one or more chemicals], which is [are] known to the State of California to cause cancer, and [name of one or more chemicals], which is [are] known to the State of California to cause birth defects or other reproductive harm. For more information go to www.P65Warnings.ca.gov."

 When a warning is for both carcinogen exposure and reproductive harm exposure from the same chemicals, the warning language should read:

"This product can expose you to chemicals including [name of one or more chemicals], which is [are] known to the State of California to cause cancer and birth defects or other reproductive harm. For more information go to www.P65Warnings.ca.gov."

A short-form warning on a product label should read, as applicable:

  • "Cancer - www.P65Warnings.ca.gov."
  • "Reproductive Harm - www.P65Warnings.ca.gov."
  • "Cancer and Reproductive Harm - www.P65Warnings.ca.gov."

When the Proposition 65 warning requirement applies the warning label must have warning triangle that must be:

  • To the left of the warning language.
  • No smaller than the word WARNING.

For example:

  Internet Sales Requirements. Even when there is an on-product warning that meets the relevant Proposition 65 requirements, internet retailers must give a separate warning for a product sold online. The warning may be:

  • At the product display page:
  • the warning itself; or
  • a clearly marked hyperlink with the word WARNING.
  • Otherwise prominently displayed to the customer before sale of the product.

When the Product May Not Require a Warning. Even a product that contains Proposition 65 chemicals may not require a Proposition 65 warning if:

  • The OEHHA has established safe harbor levels for the particular chemicals.
  • The exposure caused by the product falls at or below these levels.
  • Safe harbor levels are:
  • No Significant Risk Levels for chemicals listed for cancer; and
  • Maximum Allowable Dose Levels for chemicals listed for birth defects or other reproductive harm.
